Introduction

Sport Dinaco Inc. (“ Sport Dinaco” or the “ Company”) is a distributor of high-end sporting goods headquartered in Lachine (province of Québec). For more information about our services, please refer to our website: https://www.sportdinaco.com/en/home.
Sport Dinaco collects your personal information on its own behalf and we recognize the importance of protecting your personal information. This Privacy Policy explains how Sport Dinaco collects, uses, retains and discloses your personal information applying to all customers or prospective customers of Sport Dinaco’s website, marketing campaigns,

social media accounts, and services or products. This Privacy Policy applies to users and customers of Sport Dinaco’s website (the “ Site”), services and products.

Sport Dinaco does not seek to collect personal information from individuals outside the Canadian jurisdiction. However, if you believe Sport Dinaco is doing so, please let us know.

By providing your personal information to Sport Dinaco after you have been informed of this Policy, pursuant to applicable law, you consent to the collection, use, retention and disclosure of your personal information in accordance with the terms of this Policy. Your consent may also be implied in certain cases, depending on your reasonable expectations.

Sport Dinaco reserves the right to update this Policy at any time and such changes will be effective as of the date indicated in the change. Please check this Privacy Policy periodically for changes. Sport Dinaco will consider that you have accepted the changes to this Policy if you continue to provide personal information to Sport Dinaco after the changes take effect.

This Privacy Policy is incorporated into, and part of the Sport Dinaco Terms and Conditions of Use, which governs your access to and use of the Site, including any information, product and service offered by Sport Dinaco via our Site.

How do we collect your personal information and what type of personal information do we collect?

Your personal information is collected directly from you when you provide it to Sport Dinaco. In particular, we collect the following personal information: last name, first name, address, e-mail address, telephone number, mobile number and facsimile number.

The types of personal information collected by Sport Dinaco depend on a number of factors and the context. Sport Dinaco collects only the personal information it considers necessary for the conduct of its business and the fulfillment of its identified purposes.

Sport Dinaco collects personal information, for example, when you decide to subscribe to a newsletter, complete a request form, take part in a survey, e-mail us, make a request for products or services or make a purchase from Sport Dinaco.

Your personal information may also be collected on social media accounts or as otherwise permitted by applicable law. The Company may also collect personal information from third parties, provided that such third parties confirm that you have authorized them to disclose such information to the Company or that you expressly consent to such disclosure.

We also collect personal information automatically on the Site provided through analytical tools or digital tags. These analytical tools collect only a limited set of data, including the Internet Protocol address (IP address), the date and time of the visit, the pages visited, the domain used to access the website, the type and version of browser or operating system you are using, and the website you have just accessed and will subsequently access. Cookies may also be used, as described in greater detail below.

We do not collect any payment card information. Payments made on the Site are processed directly by Sport Dinaco’s service provider, which has sole access to payment card information. Online transactions are secured in accordance with the transmission standards of Sport Dinaco’s service provider, to enable the secure transmission and processing of transactions.

What is the purpose of our collection of personal information?

We collect personal information for the following purposes:

  • To respond to your requests for information;
  • To provide you with offers and information that may interest you on our products and services, in compliance with anti-spam laws and with your express consent when required;
  • To provide you with requested services or products ;
  • To administer your account and orders with us;
  • To communicate with you as part of the Sport Dinaco’s activities, for internal quality assurance purposes or to manage the quality of the information provided
  • Upon making a request through the Site (for example, a request for  a product or service, a callback, or specific marketing materials), to fulfill your request and provide you with the requested information, product or service
  • In connection with a transaction, we may also contact you to obtain your consent to participate in customer satisfaction surveys or for market research purposes;
  • To detect and prevent fraud;
  • In connection with a job application or inquiry, whether advertised on our Site or otherwise, you may provide us with information about yourself, such as a resume or curriculum vitae, and we may use such information throughout Sport Dinaco for the purpose of employment consideration, or to reply to your inquiry;
  • In order to maintain the accuracy of the information we collect and to help us provide better service to our customers;
  • As otherwise required or permitted by applicable law.

If we wish to use your personal information for a purpose not previously disclosed to you, we will seek your separate consent before using it, unless applicable law permits us to do so without your consent.

Who has access to your personal information?

Only authorized Sport Dinaco personnel who require access to your personal information in the course of their duties have access to it.

We will only disclose your personal information to third parties in the following cases:

  • You have authorized us to share your information with a third party for a specific purpose;
  • We will disclose your personal information to third parties that act on behalf of Sport Dinaco as mandataries or service providers (e.g. IT service providers, hosting providers or marketing solution providers), and information will be disclosed to them only for the purpose of providing such service, it being understood that these third parties will be bound by strict contractual terms that require them to maintain the confidentiality of all information, to use it only for the purpose of providing the service and not to retain the information once the agreement with the third parties has expired;
  • To comply with legal requirements;
  • If we are required to provide personal information in response to a court order, government inquiry or as otherwise required by applicable law;
  • If Sport Dinaco ever sells its business or assets, in whole or in part, or amalgamates, as required by such a transaction, as well as for due diligence purposes;
  • As required or permitted by applicable laws.

What are the roles and responsibilities of our personnel that has access to personal information?

Our employees are informed by Sport Dinaco of their obligation to maintain the confidentiality of personal information and we make them aware of the importance of protecting the confidentiality of personal information. Our employees may only use personal information in accordance with the terms of this Privacy Policy.

Where is personal information stored and will it be disclosed outside Quebec?

Depending on the nature of the personal information, your personal information may be stored at our offices, in our various computer systems or those of our service providers, or in our storage facilities or in those of our service providers.

Your personal information may be disclosed outside Quebec or Canada for the purposes described above.

How long do we keep your personal information?

Sport Dinaco retains the personal information it collects as long as necessary for the fulfillment of the identified purposes, provided it is reasonable to do so for legal or commercial purposes. The length of retention depends on the identified purposes and the nature of the information. At the end of the period of retention, the information will be destroyed, deleted or made anonymous in accordance with applicable law.

What rules apply to websites and social media sites operated by third parties?

The Site may contain links to third-party websites or applications (collectively and individually the “Third-Party Sites”) that may redirect you away from the Site. The Company provides these links for your convenience. The Third Party Sites are not under the control of Sport Dinaco, which therefore has no control over the privacy and confidentiality practices of the Third Party Sites. As a result, any personal information that is transmitted through Third Party Sites is subject to the privacy policies of those Third Party Sites. It is your responsibility to read these policies to ensure the protection of your personal information.

Sport Dinaco may also use social media (e.g, Facebook and LinkedIn) in addition to operating the Site. Third-party social media websites are not under the control of Sport Dinaco. Sport Dinaco therefore has no control over the privacy and confidentiality practices of third-party sites. When interacting with Sport Dinaco on social media, you are responsible to first read the terms of service and privacy policies of such third-party service providers and the applications used to access them. It is your responsibility to read them in order to ensure the protection of your personal information.

Personal information provided to Sport Dinaco through social media accounts is collected to capture conversations (e.g., questions and answers, comments, “likes”, etc.) between users and Sport Dinaco. Such information may be used to respond to inquiries or for statistical, evaluation, or reporting purposes, or for any other purpose specified in this Privacy Policy.

Cookies and other functions used for identifying, locating or profiling individuals

We sometimes collect non-identifiable information from visits to our Site to help us provide better customer service. For example, we keep track of the domains from which people visit, and we also measure visitor activity on our Site, but we do so in ways that keep the information non-identifiable. This information is sometimes known as “clickstream data.” Sport Dinaco or others on Sport Dinaco’s behalf may use this data to analyze trends and statistics and to help us provide better customer service. This information is not reviewed at an individual level. We collect such information through the use of various technologies including one called “cookies.”

A cookie is a piece of data that a web site can send to your browser, which may then be stored on your computer as an anonymous tag that identifies your computer but not you and can only be read by the website that placed the cookie on your hard drive. What measures are taken to ensure the confidentiality and security of personal information?

Sport Dinaco recognizes the importance of safeguarding your personal information in our possession from unauthorized access or use. We are committed to protecting your personal information. Once this website receives your transmission of personal information, we utilize commercially reasonable technology and processes to help us keep your information secure. We implement reasonable physical, administrative and technical safeguards to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. The nature of the security safeguards varies depending on the sensitivity of the personal information collected, the amount, distribution and format of the personal information, and the method of storage. When personal information is destroyed, we take care to prevent unauthorized persons from gaining access to it.

Please recognize, however, that no company can perfectly protect personal information. In addition, the Internet and communications cannot be guaranteed to be 100% secure and it is possible that others may unlawfully intercept or access information, transmissions or communications to, from or within our Site. By using our Site you are agreeing to assume these risks.

Do we collect personal information relating to minors?

Sport Dinaco intends to comply with applicable laws regarding the privacy of minors and advertising directed at them. Sport Dinaco does not seek to collect personal information from minors under the age of 14 without the verified consent of their parents or legal guardians. However, if you believe that the Company is doing so, please let us know.

What are your rights and how can you exercise them?

Sport Dinaco takes reasonable steps to ensure that personal information the company collects is accurate, complete and current.

According to the terms of applicable laws, you have the following rights, (i) to consult your personal information, ii) to rectify your personal information, iii) to withdraw your consent at any time (the withdrawal of consent binds us but will not affect the use based on your consent prior to its withdrawal), iv) to request the deletion of your personal information.

You may exercise the foregoing rights at any time by contacting the Privacy Officer at: pp@sportdinaco.com.

Please include your name, email address and postal address in your request. The request must contain sufficient information for us to be able to process it. We undertake to respond to requests within a reasonable time and, insofar as possible, within thirty (30) days, as provided for by applicable laws. However, we must first verify the identity of the person making the request.

Sport Dinaco will ensure that your personal information is as accurate, complete and up-to-date as possible for the purposes for which it is to be used. It is, however, your responsibility to ensure that your personal information, such as contact information, is kept up to date with us.

Is it possible to refuse the collection of personal information

You may refuse the collection of your personal information. However, refusal of such consent may limit our ability to provide services or products to you. We will not refuse to fulfill your request for products or services if you refuse such consent, unless the collection is necessary for that purpose. Your consent to our use of your personal information for secondary purposes is therefore not required. The same rules apply if you withdraw your consent.

You may contact the Privacy Officer to exercise your rights, to ask questions about our privacy practices or to make a privacy-related complaint.

For any complaints regarding this Privacy Policy or the protection of your personal information, you may contact our Privacy Officer at the above-mentioned email. Sport Dinaco will acknowledge receipt of your complaint, investigate such complaints and will inform you of the findings of the investigation.

If your complaint is justified, we will take appropriate measures to rectify the situation.

If you are not satisfied with the internal review of your complaint, you can contact the Commission d’accès à l’information du Québec or the Office of the Privacy Commissioner of Canada, or any other relevant regulatory authority.
